Judge Tosses NYC's Ban on Large Sugary Drink

In a win for...ummm...soda, soda-lovers and large cup companies, a judge has thrown out NYC's proposed ban on sugary drinks over 16 oz, saying the rule was "arbitrary and capricious"...take a look if you'd like to read the whole story, but I think this sums it up well...
State Supreme Court Justice Milton Tingling in Manhattan ruled the new regulations are "fraught with arbitrary and capricious consequences. The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole….the loopholes in this rule effectively defeat the state purpose of the rule."

It's not that I think we need large drinks or that we couldn't use some help getting over some bad habits...I just don't think this type of ban would do anything except annoy people. If you want more that 16oz, just buy two...or get a refill...or buy a 2 liter and lug it around all day...

It's just a simple, lazy rule that's easily avoided and would, I imagine, cost restaurants and the police more to regulate than it would help those that actually need it.
